The Donut Shoppe runs a Haven chat server at haven.thedonutshoppe.com and a Minecraft server at play.thedonutshoppe.com (together, "the services"). These terms are the agreement between you and the operator of those services. Using them means you accept these terms. If you don't, don't use them.
These terms cover the services above. The Haven for iOS app has its own privacy policy, and if you got the app from the App Store, Apple's standard licence covers the app itself.
Who may use the services
You must be 18 or older. You must not be barred from using the services under the laws that apply to you, and you must not have been previously removed from them.
Your account
Keep your password to yourself and pick one you don't use elsewhere. Two-factor authentication is available and recommended. You are responsible for what happens under your account. Tell the operator promptly if you think someone else has got into it.
You may delete your account at any time, from the app or the web client. That erases the account permanently, and optionally everything you posted. It cannot be undone.
What you may not do
Don't post or share:
- sexual content involving anyone under 18, in any form — this is reported to
the authorities, not merely deleted;
- content that threatens, harasses, stalks, or incites violence against anyone;
- content that promotes self-harm or disordered eating;
- material you have no right to share, including other people's copyrighted
work and private information about people who did not consent;
- malware, phishing, spam, or anything designed to damage or gain unauthorised
access to a computer;
- content that is illegal where you are or where the server is hosted.
Don't attempt to break, overload, probe, or gain unauthorised access to the services or anyone else's account. Don't use the services to run a commercial operation without asking first. Don't evade a ban.
Your content
What you post stays yours. To run the service at all, the operator needs permission to store your messages and uploads, show them to the people you send them to, and keep the backups that make the server recoverable. Posting is that permission, and it lasts as long as the content is on the server. Delete your content or your account and that permission ends, subject to backups aging out and to copies other people may have already made.
You are responsible for what you post. Don't post anything you don't have the right to.
Moderation
The operator may remove content, suspend an account, or ban someone, with or without notice, when these terms are broken or when it's necessary to keep the service working or its users safe. There's no obligation to review everything posted, and not reviewing something doesn't mean it's approved. The service is provided as it is
This is a hobby server run by one person. It comes with no warranty of any kind: no promise that it will be available, that messages will be delivered, that anything will be preserved, or that it is fit for any particular purpose. Keep your own copies of anything you would be sorry to lose.
Direct messages in Haven are encrypted end to end, so the operator cannot read them. Everything else — channel messages, uploads — is stored in a form the operator can read. Treat the service as a place for ordinary conversation, not for anything confidential.
Limitation of liability
To the fullest extent the law allows, the operator is not liable for indirect, incidental, special, consequential, or punitive damages, or for lost data, lost profits, or loss of goodwill, arising out of your use of the services. Where liability cannot be excluded, it is limited to one hundred US dollars.
You agree to indemnify the operator against claims arising from content you posted or from your breach of these terms.
Some places don't allow these exclusions, in which case they apply only as far as that place allows.
Ending things
You may stop using the services and delete your account at any time. The operator may suspend or end your access at any time, and may shut the services down entirely — this is a personal project, not a company. The sections on your content, disclaimers, liability, and governing law survive.
Changes
These terms may change. The date at the top changes with them, and continuing to use the services after a change means accepting it. Material changes will be announced on the server where practical.
Governing law
Ohio law governs these terms, without regard to its conflict-of-law rules. Disputes go to the state or federal courts serving Hamilton County, Ohio.
